By using this Website, you confirm that you have read, understood and accepted these terms and conditions of Sales.

These Images belong to JW Sommelier Consulting Ltd or third parties to JW Sommelier Consulting Ltd and are protected by relevant intellectual property laws. By using the Website, you may view the Website; make a print copy and/or download part or all of the Website onto the computer used to access this site, only for the purposes of personal use, information, research, or study. Nothing in the Website shall be taken to grant a user any license or right of use or any image without the express written permission of the owners of those Images.

Sales and Purchase of the JW Somm Online Store
The Agreement between you and JW Sommelier Consulting Ltd for the supply (Sales) of wine or other goods purchased (Purchase) from the online store (“the Agreement”) is deemed only to come into existence when JW Sommelier Consulting Ltd accepts your order. No obligation to sell the Products and Services will arise until such acceptance. Each order you place will amount to a separate Agreement.
Quality Guarantee
JW Sommelier Consulting Ltd will endeavour our best to provide quality Products and Services at any time possible. If for any reason that you are not entirely satisfied with your order or you suspect Products may be affected by a quality issue, please do not hesitate to contact us and we will remedy the problem. Liquor Licensing & Responsible Service of Alcohol
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. If we have reason to believe that a person ordering wine is not 18 years of age or older, JW Sommelier Consulting Ltd reserve the right to refuse or cancel the order.

Creating an Account for the JW Sommelier Consulting Ltd Online Store
JW Sommelier Consulting Ltd online store may offer a registration facility for users who wish to create an account on the Website. Subject to your Subscription, your order constitutes an order for a recurring Purchase and delivery of Products and will, subject to the rights to pause and terminate, continue indefinitely.
As a registered user, you will be able to edit these details. You warrant that you are over the age of 18 years and legally entitled to select a Subscription for the Purchase of the Products.
When you register, you will nominate a password. You agree to keep your login details safe and confidential at all times, and to ensure that no person or persons use your login to purchase any Products. You should immediately notify us of any unauthorized use of your logon or password or any other breach of security of which you become aware.
Security
All credit card information is encrypted during transmission and no credit card information is stored on this Website. All payment processing is provided by the DPS which is fully PCI DSS compliant. PCI DSS (Payment Card Industry Data Security Standard) is a set of standards created by card issuers such as Visa and MasterCard to ensure the security of credit card details online. This standard has been created to assist in ensuring that sensitive customer data remains secure at all times. JW Sommelier Consulting Ltd will never sell, trade or rent your personal information.
Deliveries and Unattended Deliveries
You are liable for every order made under the Agreement and all the details that you provide for delivery. You agree that you are over the age of 18 years and legally entitled for Purchase of the Products to deliver to your nominated address.
Deliveries will be made to an address nominated by you which must be registered to and accepted based on suburb and postcode confirmation by JW Sommelier Consulting Ltd. The nominated address must be easily accessible otherwise will be deemed unsafe and an additional fee may charge for such repeated delivery.
As we outsource deliveries globally, we are unable to accept orders conditional on a specific date or time. While every endeavour will be made to have deliveries occur at a requested time, this cannot be guaranteed.
PLEASE ALLOW UP TO 10 DAYS FOR DELIVERY WITHIN NEW ZEALAND. Most deliveries occur much sooner than this. There is a flat fee of delivery of $6.50 for a case of 6 units or less and $12 for a case of 12 or less. Express delivery can be arranged, there will be an additional delivery fee.
JW Sommelier Consulting Ltd will not be liable for any direct or indirect loss or damage of the Products due to circumstances beyond the control of JW Sommelier Consulting Ltd.
You agree that all the delivery of your Products is either the customer or someone authorised by you to receive Products on your behalf. It is your responsibility that the authorised person who is over the age of 18 years old.
Defects
It is your liability to inspect the Products on delivery within forty-eight (48) hours of delivery and notify JW Sommelier Consulting Ltd of any incorrect item, shortage of quantity, alleged defect, damage or failure to comply with the description in writing and image of proven. If you shall fail to comply with these provisions the Products shall be presumed to be free from any defect or damage.
For defective Products, it shall be JW Sommelier Consulting Ltd discretion to you are entitled to reject, repair, replacement or refund of the purchased price of the Products. We will accept no responsibility for Products that have already been opened or modified.
Returns
Products have been purchased with JW Sommelier Consulting Ltd will only be accepted returns provided by complying with the provisions of the clause and above.
We will agree to return the Products when JW Sommelier Consulting Ltd has written to accept the return of the Products, and the Products are returned at your own cost within thirty (30) days of the delivery date. If the Products have not been stored or used in a proper manner or in that JW Sommelier Consulting Ltd will not be liable for the same Product replacement or full refund on purchased price.
JW Sommelier Consulting Ltd will not accept non-stockist items, Products of second quality, discounted Products, or Products made to your specifications are under no circumstances acceptable for credit or return.
Without prejudice to any other remedies, JW Sommelier Consulting Ltd may have, if at any time you are in breach of any obligation (including those relating to payment) JW Sommelier Consulting Ltd may suspend or terminate the supply of Products to you and any of its other obligations under the Conditions.
Cancellation
JW Sommelier Consulting Ltd may cancel any contract to which these conditions apply or cancel delivery of Products and Services at any time before the Goods and Services are delivered by giving written notice to you. On giving such notice JW Sommelier Consulting Ltd shall repay to you any sums value paid in respect of the purchased Products. JW Sommelier Consulting Ltd shall not be liable for any loss or damage whatsoever arising from such cancellation.
Product Availability
All Products are ‘while stocks last’. JW Sommelier Consulting Ltd may delay the dispatch of orders due to stock availability. JW Sommelier Consulting Ltd may substitute for similar Products of equal or higher value or full refund.
Pricing & Promotions
The Product, prices, promotions and delivery fee offered on our online store (The Agreement) are quoted in New Zealand dollars and are inclusive of GST. Prices will either be per bottle or case as stated on the Website. Delivery charges are shown separately and are not included in the displayed Product pricing.
JW Sommelier Consulting Ltd prices are subject to variation – the price payable for the Product is the price applicable on the date when JW Sommelier Consulting Ltd confirms your order.
Payment
JW Sommelier Consulting Ltd currently accepts Master Card, Visa, American Express and Direct Deposit. You warrant that any banking details provided by you are true and correct and that you are authorised to charge the relevant payment to that account. If the issuer of the card or the owner of the account does not authorise the transaction or later revokes authorisation for the transaction, we reserve the right to cancel the order. JW Sommelier Consulting Ltd will not be liable for any payment transactions which are later identified as unauthorised.
JW Sommelier Consulting Ltd reserves its rights to recover any debt via a debt collection agency. You agree to indemnify JW Sommelier Consulting Ltd for the costs of collection of any overdue amounts, including the costs incurred by JW Sommelier Consulting Ltd in recovering the debt.
General
We may update or amend these terms of The Agreement without notice, to comply with the law or to adjust to changing business requirements. You are responsible to check this page from time to time to acknowledge changes in place. Such changes will be effective as soon as they are posted on this Website. You agree to be bound by the terms of these updates and amendments.
